{"id":449,"date":"2018-04-05T19:42:37","date_gmt":"2018-04-05T19:42:37","guid":{"rendered":"http:\/\/blog.quriusolutions.com\/?p=449"},"modified":"2018-04-05T19:42:37","modified_gmt":"2018-04-05T19:42:37","slug":"recall-process-dino-melaye-heads-for-supreme-court","status":"publish","type":"post","link":"https:\/\/blog.quriusolutions.com\/?p=449","title":{"rendered":"Recall process: Dino Melaye heads for Supreme Court"},"content":{"rendered":"<p>Senator Dino Melaye (All Progressives Congress \u2013 Kogi West) has lodged an appeal at the Supreme Court against the March 16, 2018 judgment of the Court of Appeal, Abuja, which affirmed the power of the Independent National Electoral Commission (INEC) to conduct a referendum for the purpose of recalling a legislator unhindered.<\/p>\n<p>Melaye, in a notice of appeal dated April 3, 2018, filed by his lawyer, Mike Ozekhome (SAN), urged the Supreme Court to among others, set aside the Court of Appeal judgment, which upheld an earlier judgment by Justice Nnamdi Dimgba of the Federal High Court, Abuja.<\/p>\n<p>INEC had in July last year, on receiving a petition from some registered voters from Melaye\u2019s constituency, requesting his recall on grounds of non-performance, wrote to notify him about the petition and further steps it intended to take.<\/p>\n<p>On learning about the petition, Melaye filed fundamental rights enforcement suit before the Federal High Court, Abuja, accusing INEC of not affording him fair hearing by not serving him with a copy of the petition to enable him to respond.<\/p>\n<p>Melaye wants the Supreme Court to, among others, declare that the statutory 90-day period for INEC to conduct a recall process, provided in Section 69(b) of the Constitution, having elapsed by effluxion of time on September 23, 2017, INEC can no longer validly proceed on the basis of the petition for his recall, presented on June 23, 2017.<\/p>\n<p>He equally wants an order of perpetual injunction, restraining INEC from commencing or further proceeding with the process of acting on the petition presented to it by his supposed \u200econstituents. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Senator Dino Melaye (All Progressives Congress \u2013 Kogi West) has lodged an appeal at the Supreme Court against the March 16, 2018 judgment of the Court of Appeal, Abuja, which &hellip; <\/p>\n","protected":false},"author":2,"featured_media":450,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[93],"tags":[],"_links":{"self":[{"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=\/wp\/v2\/posts\/449"}],"collection":[{"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=449"}],"version-history":[{"count":1,"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=\/wp\/v2\/posts\/449\/revisions"}],"predecessor-version":[{"id":451,"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=\/wp\/v2\/posts\/449\/revisions\/451"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=\/wp\/v2\/media\/450"}],"wp:attachment":[{"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=449"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=449"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/blog.quriusolutions.com\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=449"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
